Court set hearing date on the case of Ilgar Mammadov

Sheki Court of Appeal will hold the hearing in April 29 based on the complaint of Ilgar Mammadov, jailed chairman of the Republican Alternative (REAL) Movement and Tofiq Yaqublu, deputy head of the Musavat party. Fuad Agayev, Ilgar Mammadov’s attorney published on his facebook profile.

The attorney wrote that he was told from Sheki Court of Appeal there was a misunderstanding about the date of proceeding. The decision of court on the case of ilgar Mammadov and Tofiq Yaqublu will be announced tomorrow at 17:00 pm.

Sheki Court of Appeal adjourned the proceeding for an indefinite time in  April 22. That day the attorneys have requested the acquittal of Ilgar Mammadov and Tofiq Yaqublu in accordance with the decision adopted by the European Court of Human Rights in favor of Ilgar Mammadov.
But public prosecutor requested to uphold the decision of court of the first instance.

Ilgar Mammadov and Tofiq Mammadov both pleaded  in a  court to acquit them. Sheki Court on Grave Crimes sentenced Ilgar Mammadov to 7 years, Tofiq Yaqublu to 5 years in prison. The conviction was appealed but  Sheki Court of Appeal uphold the initial decision. Afterwards defendants appealed to the Supreme Court in cassation. In  a letter of appeal  it is noted to reverse the decision of court  and set them free.

The Supreme Court partly satisfied the claim. The decision of Sheki Court of Appeal on Ilgar Mammadov and Tofiq Yaqublu was reversed and the case was returned back to Sheki Court of Appeal.

Ilgar Mammadov and Tofiq Yaqublu have been imprisoned  on charges of staging riots in Ismayili,Azerbaijan in January,2013. 

Tofiq Yaqublu  was released following the pardon granted by president Ilham Aliyev in March, 2016.
