With the decision of Baku City Sabail District Court on May 21, 2016 Javid Huseynov was convicted with the article 307.1 (willfully not informing about preparing or committing grave crime) and article 307.2 (concealment of a serious crime without a prior consent) of Criminal Code of Azerbaijan and sentenced to four years in prison. This is the maximum term of imprisonment for those articles.

The Committee also states that the Baku City Prosecutor's  Office should have sent the case of Javid Huseynov  along with the case of other accused persons (Elshan Ismayilov, Jamal Mammadov, Arif Aliyev, Kanan Madatov and Samir Mustafayev) to court or in line with legislation separately should have reviewed  the case during the period of investigation.

Only in that case his punishment would have been adequate. But it did not happen and Javid Huseynov was deprived from freedom for 4 years. But now the Court of Appeal released the former football player.

 "Public Committee established for support on the objective investigation of journalist Rasim Aliyev’s murder”  believes that scheduling the hearing date of the  Court of Appeal on the day which marks 1 year and two months of  Javid Huseynov’s  imprisonment and releasing him by reducing his sentence to 1 year and 2 months of imprisonment  is not a coincidence.

On October 8, 2016 the lawyer of Javid Huseynov took back cassation appeal filed against the preliminary ruling of Court of Appeal and instantly Court of Appeal hearing has been scheduled. 

"Public Committee established for support on the objective investigation of journalist Rasim Aliyev’s murder” considers that the football player Javid Huseynov has a direct relation with the death of the employee of ann TV, journalist Rasim Aliyev.

According to Teyfura Aliyeva, the mother of a journalist, Rasim Aliyev has agreed to meet with Elshan Ismayilov who is a cousin of Javid Huseynov, after talking on the phone with Javid Huseynov.

The investigation materials and the correspondence between Elshan Ismayilov and Javid Huseynov on WhatsApp messenger which was widely spread on mass media clearly proves that Javid Huseynov was aware that his cousin is willing to meet and beat the journalist.

However he did not prevent that and failed to report this to law enforcement. In this case release of Javid Huseynov  raises doubts and questions.

"Public Committee established for support on the objective investigation of journalist Rasim Aliyev’s murder” considers that release of Javid Huseynov sets negative precedent in society and it can be perceived that a journalist can be killed for more or less famous football player.
