Azerbaijan to create register of customs representatives

Azerbaijan plans to reform its customs representation system by replacing the term “customs broker” with “indirect customs representative” and abolishing licensing in the sector.

The relevant amendments to the Customs Code are due to be discussed in parliament on May 1.

Under the draft changes, entities seeking to operate as indirect customs representatives will no longer need a licence but will instead have to be included in a special register to be published on the customs authority’s website. The move is expected to improve access to services for foreign trade participants and promote competition in the market.

Indirect customs representation will be carried out by legal entities. During customs control and clearance, they will assume all the obligations of the person moving goods across the customs border and bear the corresponding responsibility. Customs declarations and other documents will be submitted electronically by the legal entity acting as the declarant.

The amendments also introduce the institution of direct customs representation, which will be carried out by individuals on the basis of a power of attorney issued by the represented person. The authors of the bill say this will create additional opportunities for participants in foreign economic activity.

The proposals also envisage simpler requirements for customs carriers. At present, only licensed legal entities may operate in that capacity, but under the changes both legal entities and individual entrepreneurs will be able to do so. Licensing of this activity will also be abolished.

The authorised body will maintain and publish regularly updated lists of customs carriers on its official website. This is expected to increase market transparency and help build an electronic record of market participants.

The draft also предусматривает the collection of a customs fee for issuing qualification certificates to customs clearance specialists, in an amount to be set by the relevant executive authority.
