Decision issued on former Ukrainian deputy minister charged alongside Oleg Bakinski
A court hearing has been held on the cassation appeal and cassation protest filed against the decision regarding former Deputy Minister of Defense Industry of Ukraine Konstantin Kucher, who is charged together with Ukrainian millionaire Oleh Krapivin, known in criminal circles as “Oleg Bakinski,” and arrested in Azerbaijan on hooliganism charges.
A decision was made at the hearing held at the Supreme Court under the chairmanship of Judge Rashad Abdulov.
According to the decision, the cassation appeals filed by the parties were not upheld. It was noted that the state prosecutor withdrew the cassation protest.
Note that under the verdict of the Baku Court on Grave Crimes, Konstantin Kucher was acquitted of charges under Article 178.4. Under Article 221.3, however, he was sentenced to 2 years and 6 months in prison. The Baku Court of Appeal upheld the verdict. An Amnesty Act was applied to him, and his sentence was reduced by six months by a decision of the Garadagh District Court.
Oleh Krapivin was also sentenced to 2 years and 6 months of imprisonment. Article 70 of the Criminal Code was applied to him, and his sentence was considered conditional with a probation period of 6 months. He was ultimately charged under Articles 127.2.3 (intentional infliction of less serious harm to health committed by a generally dangerous method or with hooligan intent) and 221.3 (hooliganism committed with the use of a weapon or objects used as a weapon, accompanied by violence against the victim or destruction or damage to another person’s property) of the Criminal Code.
An amnesty act was applied to him, and by a decision of the Khatai District Court, he was released from the conditional sentence.
