"We have lodged a complaint  to institute legal proceedings against doctors.” said journalist Rasim Aliyev’s father Mammadali Aliyev in his interview to ANN.az whose son was beaten to death last year.

Memmedeli Aliyev, the father of late journalist Rasim Aliyev said that their main complaint is related with doctors: "The lawyer has filed this complaint to court at our request on April 20.Our next complaint will be about Javid Huseynov.Currently his case is underway and sentence was not issued.Following the decision of court we will review this issue.We expect the court to issue sentence against Javid.But we have plan in this regard.”

Asabali Mustafayev,the attorney of victim’s side confirmed to ANN.az that he had filed a complaint against doctors:| "The main reason of this is that the court of first instance did not look into a complaint about doctors .In the complaint the names of all doctors mentioned in regard with this crime asking why they were not brought to justice.”

We have contacted the press service of the Ministry of Health of Azerbaijan on this issue. The ministry said that they did not receive any appeal about doctors.

Besides the parents of Rasim Aliyev, the people charged over the of death of the journalist –Jamal Mammadov, Arif Aliyev, Kanan Madatov and Samir Mustafayev had also appealed the decision  concerning themselves.

Safar Huseynov, the lawyer of Elshan Ismayilov accused of the murder of Rasim Aliyev told ANN.az that appeal was not filed.

The last day for appeal by people charged over the death of the journalist fell on April 21. Despite that, Elshan Ismayilov still did not file an appeal.

Rasul Yusifbeyli, defendant Kanan Madatov’s lawyer has confirmed to ANN.az about filing an appeal.

Shamsaddin Quliyev, the lawyer of another defendant accused of the murder of journalist told ANN.az that appealing the decision: "Probably the complaint left at the chancellery of the court. But we have filed an appeal on this case.”

The lawyer of Samir Mustafayev accused of death of the journalist in his interview to media said that he has filed an appeal on April 20: "Petition of appeal was presented to the Baku Court of Appeal. In the coming days the court date will be disclosed.”

Arif Aliyev, accused of the death of the ANN.TV employee Rasim Aliyev has lodged an appeal. The copy of the complaint was handed over to Teyfura Aliyeva, the mother of late journalist.

Rasim Aliyev , ANN.tv’s employee was beaten by a group of people on April 8, 2015 in the Bayil settlement of Baku. He was delivered to Clinic Medical Center with multiple physical injuries and the next day passed away there. Baku City Prosecutor'S Office started criminal case under article 126.3 (intentional infliction of harm resulting in death of the injured person).
 
Elshan Ismayilov, Jamal Mammadov, Arif Aliyev, Kanan Madatov and Samir Mustafayev were detained as suspects in the murder of Rasim Aliyev.
The former captain of the Gabala football club Javid Huseynov was also arrested as a suspect of murder of the journalist.

There were reasonable grounds to believe that Javid Huseynov knew that his cousin Elshan Ismayilov was preparing a crime, but hid this information.
During the investigation, the materials of the criminal case regarding the football player Javid Huseynov were filed in a separate lawsuit under article 307.1 (not informing about known, prepared or committed heinous crimes) and article 307.2 (not promised covering up of a heinous crime) of the Criminal Code of the Azerbaijan Republic.

On April 22 the criminal case started by Baku City Prosecutor's Office was completed. In accordance with the court's judgement, E.Ismayilov has sentenced for 13 years, A.Aliyev for 12 years 6 months, J.Mammadov 11 years, S.Mustafayev and K.Madatov for 9 years.
 
Javid Huseynov's case is currently is pending.
