Constitutional Court Issues Key Ruling on Sentencing and Amnesty Application
Chaired by Farhad Abdullayev, the Plenum of the Constitutional Court of Azerbaijan held a regular session to review a referral from the Narimanov District Court of Baku regarding the interrelated interpretation of Articles 66.5 and 81.2 of the Criminal Code in light of Articles 60 and 71 of the Constitution.
Following comprehensive review of specialized legal assessments and institutional opinions, the Plenum determined that when determining the final aggregated penalty under Article 66.5 of the Criminal Code, the portion of a sentence remitted pursuant to an act of amnesty must not be incorporated into the calculation or absorption of punishments. The ruling takes effect from the date of publication, carries final legal authority, and is not subject to appeal or external alteration.
