Azerbaijan tightens remote lending rules, introduces loan self-ban option
Effective October 1, updated regulatory requirements on credit risk management will enter into force in Azerbaijan, establishing enhanced safeguards for consumers against fraud during remote credit underwriting. The revised framework was approved by Taleh Kazimov, Chairman of the Central Bank of Azerbaijan.
Under the regulations, customers of commercial banks and non-bank credit institutions (NBCOs) can proactively file requests establishing a total self-ban on remote consumer borrowing and credit limit increases in their names. Lifting the restriction will require either in-person verification at a branch or remote authorization via enhanced customer authentication or qualified electronic signatures. Lenders must cross-reference applicant data against both internal systems and Credit Bureau records, with mandatory real-time SMS or push alerts triggered if unauthorized loan applications are detected.
The framework also institutes mandatory "cooling-off" disbursement delays. For remote loans not exceeding twice the national minimum monthly wage, funds may only be disbursed at least 2 hours after loan execution or modification. For loan values exceeding that threshold, the mandatory waiting period extends to 24 hours.
